Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MoonX Academy website and application (the "Service"), operated by RICH4EVER LLC, a Delaware limited liability company ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. Who we are
The Service is provided by RICH4EVER LLC, File No. 202604342, 2915 Ogletown Road, Newark, DE 19713, United States. You can reach us at support@moonx.fr.
2. What the Service is — and is not
MoonX Academy is an educational software product: video lessons, quizzes and interactive practice tools (calculators, a backtest simulator on historical data, a pattern trainer, a trade journal and an AI-assisted chart explainer).
The Service is not a broker, exchange, trading platform, investment adviser, signal service or financial institution. We do not execute trades, hold client funds, give personalised investment advice, sell trading signals, or make any representation about the profitability of any strategy. 3. Eligibility
You must be at least 18 years old and able to enter into a binding contract. You may not use the Service if you are located in a jurisdiction where doing so is prohibited, or if you are subject to applicable sanctions.
4. Your account
- One account per person. Accounts are personal and may not be shared, sold or transferred.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- Provide accurate information and keep it up to date.
5. Free tier and Tokens
The Service uses a freemium model:
- Free tier — access to the free modules and a monthly allowance of free Tokens (currently 50), which resets each month and does not roll over.
- Token packs — one-time purchases of usage credits ("Tokens") that are consumed when you run a tool or unlock a premium module. Tokens are governed by our Token Terms.
- Custom amounts — you may also purchase any number of Tokens (minimum 100) at the per-Token price displayed in the Service. All Token purchases are one-time; there are no subscriptions or automatic renewals.
Tool costs and pack prices are displayed in the Service and may change prospectively. Changes never affect Tokens already purchased.
6. Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices are shown in USD (localised at checkout) and exclude applicable VAT or sales tax, which Paddle calculates and collects based on your location. Paddle's Buyer Terms also apply to your purchase.
7. Refunds and cancellation
Refunds are handled under our Refund Policy, which forms part of these Terms.
8. Licence and intellectual property
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own learning. All lessons, videos, text, software, tools, data sets and branding are owned by RICH4EVER LLC or its licensors and protected by copyright and other laws. You may not copy, record, redistribute, resell, scrape, reverse-engineer or create derivative works from any part of the Service. Modules you unlock remain available to you for as long as your account is in good standing and the Service is offered.
9. Acceptable use
You agree not to: share accounts or Tokens; use bots, scripts or automation to consume Tokens or extract content; attempt to bypass usage limits or payment; upload unlawful, infringing or harmful content (including to the AI Chart Coach); interfere with the Service's security or operation; or use the Service to provide investment advice or signals to third parties.
10. AI-assisted features
Some tools use automated or AI models to generate educational explanations. Outputs may be inaccurate or incomplete, are provided for learning only, and must not be relied upon for any trading or investment decision. You are responsible for any image you upload and confirm you have the right to use it.
11. Availability and changes
We may update, add or remove features, lessons, tools or pricing at any time. We aim for high availability but do not guarantee uninterrupted access. If we permanently discontinue the Service, we will give reasonable notice and refund the unused balance of purchased Tokens.
12. Termination
You may close your account at any time. We may suspend or terminate accounts that breach these Terms, with notice where practicable. On termination for breach, unused Tokens are forfeited. On voluntary closure, unused purchased Tokens are refundable within the window set out in the Refund Policy.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We make no warranty that any educational content will lead to any particular outcome, financial or otherwise.
14. Limitation of liability
To the fullest extent permitted by law, RICH4EVER LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any trading or investment losses, loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, and statutory consumer rights (including under EU and UK law) are not affected.
15. Indemnity
You agree to indemnify RICH4EVER LLC against claims arising from your breach of these Terms or misuse of the Service.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, except that consumers resident in the EU, UK or other jurisdictions with mandatory consumer-protection rules keep the benefit of those rules and of their local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
17. Changes to these Terms
We may revise these Terms. Material changes will be announced in the Service or by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.
